City residents are responsible for the care and maintenance of both trees and weeds along boulevards and alleys adjacent to their property per City Code 23 and 12-92. Any trimming, planting, or removal of boulevard trees requires a permit from the City. These permits can be found on our website and returned to the Public Works Department for review and approval.
Boulevard Trees Quick Reference Guide
A "Boulevard Tree" is defined as any tree that grows within or that overhangs any public street or right-of-way.
Homeowners Responsibilities
- Property owners are responsible for the care and maintenance of trees and vegetation on their property, as well as on adjacent streets, alleys, boulevards, and public right-of-ways. (Livingston Municipal Code 23-12) This change went into effect in 2019.
Pruning/Removal Requirements
- Pruning and timing standards require that boulevard and alley trees must be maintained at a height of 13' above the street and 8' above the sidewalk. All pruning work must conform to the ANSI A300 Standards (Livingston Municipal Code 23-13) This allows adequate clearance for Emergency Services access, street sweeping and garbage truck services.
- It is prohibited for any individual, organization, or City department to top street trees, park trees, or other trees on public property.
- Boulevard trees overhanging any street or right-of-way within the city shall be pruned so that they do not interfere with or obstruct the view of any intersection or traffic control signs. (Livingston Municipal Code 23-15)
- If a boulevard tree requires removal or replacement, the property owner must follow the permitting process and obtain approval before commencing any work. This process helps keep motorists and pedestrians safe, preventing potential accidents. (Livingston Municipal Code 23-16)
Licensing Requirements
- Arborists engaging in the business or occupation of pruning, treating, or removing trees within the City must procure a city business license and provide proof of general liability insurance. (Livingston Municipal Code 23-20)
City Responsibilities
The City's responsibilities consist of maintaining trees planted on City property, including parks, and our trail systems. The City provides consultation services through our Arborist staff for residents, offering assessments of tree health, maintenance and compliance issues. The City also provides a list of approved replacement trees suitable for boulevard trees when trees are to be removed due to disease or damage sustained by high winds, or old age.
